1. This agreement
These Terms of Service (the "Terms") form the agreement between you and Aron de Groot, trading as Groot Apps, established in the Netherlands ("we", "us"), for the Orbit iPhone app and this website.
By downloading, installing or using Orbit you accept these Terms. They also serve as the end-user licence agreement (EULA) required by Apple. If you do not accept them, do not use the app.
These Terms are written for consumers. Nothing here limits the rights you hold under mandatory consumer law in your country of residence; where a clause conflicts with such a right, that right wins and the rest of the Terms stay in force.
2. What Orbit is
Orbit is a routine and habit app for iPhone, designed with ADHD in mind. It provides timers, reminders, streaks, freezes and an optional friend leaderboard.
Orbit is not a medical device and does not provide medical advice. It does not diagnose, treat, cure or prevent ADHD or any other condition, and it is no substitute for care from a qualified professional. If you are being treated, keep following your clinician's advice. If you are in crisis, contact your local emergency number or a crisis line.
3. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Orbit on Apple devices that you own or control, as permitted by the App Store Terms of Service. You may use it for personal, non-commercial purposes.
You may not: copy, sell, rent, sublicense or redistribute the app; reverse-engineer, decompile or disassemble it, except to the extent that mandatory law expressly permits this; remove notices of authorship; or circumvent the paywall or any technical protection.
The app, its design, source code, artwork and name remain ours. Your routines, notes and other content remain yours — this licence gives us no ownership of them and, since we cannot read them, no ability to use them.
4. Apple
This agreement is between you and us, not with Apple, and Apple is not responsible for Orbit or its content. Specifically:
- Apple has no obligation to provide maintenance or support for Orbit.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
- We, not Apple, are responsible for addressing any claim that the app or your use of it infringes intellectual property rights, or gives rise to product liability, consumer protection or similar claims.
- You confirm that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
5. Subscriptions and payment
Orbit offers a free tier and a paid tier (Orbit Premium), sold as weekly and yearly auto-renewing subscriptions and as a one-off lifetime purchase. Current prices, including VAT, are shown in the App Store before you confirm, in your local currency.
- Payment is charged to your Apple Account at confirmation of purchase.
- Subscriptions renew automatically unless auto-renew is switched off at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the end of the current period.
- You manage and cancel subscriptions in Settings → [your name] → Subscriptions. Deleting the app does not cancel a subscription.
- Any free trial period is forfeited when you buy a subscription during the trial.
- If we change the price, Apple will ask for your consent before the next renewal; if you do not consent, the subscription simply ends.
A lifetime purchase means the lifetime of the app: for as long as we distribute and support Orbit. It is not a promise of perpetual service on future hardware or operating systems.
6. Right of withdrawal (EU, EEA, UK)
As a consumer in the EU, EEA or UK you normally have 14 days to withdraw from a distance contract for digital content, under Directive 2011/83/EU as amended and its national implementations.
Because Orbit's paid features are supplied immediately, you are asked to consent to immediate performance at the point of purchase, and you thereby acknowledge that you lose the right of withdrawal once supply has begun. If you would rather keep the right, do not use the premium features and request the refund within the period.
This right is exercised through Apple, which is the merchant of record for all App Store sales.
7. Refunds
Apple handles all billing and all refunds for App Store purchases. We can neither issue nor block a refund. Request one at reportaproblem.apple.com, or via Settings → [your name] → Media & Purchases → View Account → Purchase History.
If Apple declines a refund that you believe you are legally entitled to, write to billing@groot-apps.com and we will support your case with Apple.
8. Legal guarantee of conformity
Under EU Directive 2019/770 on digital content and its national implementations, we owe you an app that conforms to the contract. For a one-off purchase this covers a period of two years from supply; for a subscription it covers the whole term.
If Orbit does not conform, you are entitled to have it brought into conformity, and if that fails or is disproportionate, to a proportionate price reduction or to terminate. Report defects to support@groot-apps.com. These statutory rights are free of charge and exist alongside anything else in these Terms.
9. Acceptable use
Use Orbit lawfully and decently. In particular, when using the friend leaderboard you must not:
- choose a display name that is offensive, hateful, deceptive, or that impersonates someone else;
- share invite links with people who have not agreed to receive them;
- attempt to read, alter or delete other members' records, or otherwise interfere with the CloudKit database;
- use automated means to inflate streaks, or otherwise manipulate the leaderboard.
We may remove a display name or a leaderboard record that breaches these rules. Because we hold no account for you, the sanction is limited to that record — the rest of the app keeps working.
10. Availability and changes
We aim to keep Orbit working on currently supported versions of iOS, but we do not guarantee uninterrupted availability. Features that depend on Apple's services — iCloud sync, the leaderboard, purchases — depend on Apple's uptime, not ours.
We may add, change or remove features. If a change materially reduces what a paid subscription gives you, we will tell you in advance, and you may cancel and — where the law requires it — receive a proportionate refund of the unused period.
11. Ending the agreement
You may end this agreement at any time by deleting the app; cancel any subscription separately in your Apple Account settings. We may suspend or end your licence if you materially breach these Terms — in practice, only for the leaderboard abuse described in section 9. Sections on intellectual property, liability and governing law survive termination.
12. Liability
We are liable for damage caused intentionally or by gross negligence, for death or personal injury, and for anything else that mandatory law does not allow us to exclude — including liability under the EU Product Liability Directive and rights under consumer law.
Beyond that, and to the extent the law permits, we are not liable for indirect or consequential loss, lost profits, lost data caused by circumstances outside our control (including your device failing, iCloud outages, or your own deletion of data), or for missed routines, appointments or obligations. Where liability is limited, it is limited to the amount you paid for Orbit in the twelve months before the event.
Keep your own backups. Orbit's export function exists for exactly that purpose.
13. Governing law and disputes
Dutch law applies. If you are a consumer resident in another EU or EEA country, you keep the protection of the mandatory rules of your own country — this choice of law cannot take those away.
Disputes may be brought before the competent court in the Netherlands or, if you are a consumer, before the courts of your country of residence. Talk to us first at hello@groot-apps.com: nearly everything is resolved faster that way.
The European Commission's online dispute resolution platform ceased operating on 20 July 2025, so there is no longer an EU ODR link to point you to. Your national consumer authority or alternative dispute resolution body remains available.
14. Changes to these Terms
We may update these Terms when the app or the law changes. The date at the top always shows the current version. Material changes affecting a paid subscription are announced before they take effect, and continuing to use Orbit afterwards means you accept them. If you do not, you may cancel.
